Ngilu Case Terminated by Court of Appeal
Court of Appeal Grants Permanent Reprieve to Charity Ngilu as Criminal Case Over Karen Land Scandal Is Officially Terminated
Former Lands Cabinet Secretary Charity Kaluki Ngilu has secured a permanent legal reprieve after the Court of Appeal formally terminated the long-running criminal case against her.
The breakthrough follows a consent agreement between all parties in Ngilu’s appeal, effectively ending the Anti-Corruption Court proceedings arising from the controversial 134-acre Karen land saga.
According to documents seen by Nairobi TIMES, the consent states:
“On termination of criminal proceedings against Charity Kaluki Ngilu in Anti-Corruption Criminal Case No. 13 of 2015 in the Chief Magistrate’s Court Nairobi, the appellant, Charity Kaluki Ngilu, will not pursue any claim from the Office of the Attorney General, the Director of Public Prosecutions and the EACC.”
This means Ngilu is barred from suing the DPP, EACC, or the Attorney General over her prosecution.
Why Ngilu Was in Court
Ngilu had been charged with obstructing EACC officers investigating the Karen land scandal. Prosecutors alleged she instructed senior Lands Ministry officials not to record statements with investigators probing the disputed property.
She was arraigned on June 19, pleaded not guilty, and was freed on KSh1 million cash bail. Several senior lands officials facing related charges were also released on bail.
With the appeal concluded and the charges terminated, the court has ordered that Ngilu’s cash bail be refunded.
The termination marks a major turning point in a high-profile corruption saga that has lingered for nearly a decade.
